Appendix 1

Indenture of Apprenticeship

Held currently by David E.V.Chalmers (brother of the author)
Indenture betwixt John Hay and David Chalmers 1806

It is Contracted agreed and Ended betwixt the parties following viz. John Hay Selator in Milnthort on the one part and David Chalmers son to Francis Chalmers Taylor in Lochgelly and Alexander Adam in Keltie as Cautioner and Suerty for the said David Chalmers on the other part in manner following; That is to say the said David Chalmers hereby becomes bound an apprentice to the said John Hay in his art and business as slater for the space of seven years from and after the first day of July one thousand eight hundred and five which notwithstanding the date hereof is hereby declared to have been the period of his entry to his apprenticeship during which space and time David Chalmers Binds and Obliges himself to serve the said John Hay as a faithful and honest apprentice and shall not at any time hear or see any thing said or done to his Masters disadvantage without timeously acquainting him thereof and preventing as far as in his power lyes That he shall not reveale his Masters secrits nor absent himself from his service without leave asked and obtained otherwise to serve two days for each days absence after the expiry of these Indentures and for the said David Chalmers his performance of the above obligations shall come under by turn the above Alexander Adam hereby Binds and Obliges him and his heirs the Exexcutors as Cautioner and Surety for the said David Chalmers For the which Casuses and on the other part the said John Hay Binds and Obliges him and his heirs and Executors whatsoever to teach learn and instruct the said David Chalmers in his art and business of a Selator and that he shall not conceal any part thereof from his said apprentice and shall do his utmost endeavour to cause him to learn and understand the same so far as he the said John Hay knows and practices and the said John Hay Binds and Obliges him and his forwards to maintain his said apprentice in Bed Board Cloathing and washing during the period of his apprenticeship and also to uphold him in all necessary working tools And both parties Bind and Oblige themselves and their fowards to implement their respective parts of the promises to each other under the penalty of Ten pounds Stg. to be paid by the party failing to the party observing or willing thereto and that over and above performance and they Consent to the Registration hereof in the Books of Council and Session or others competent that Letters of Lerning and six days charge and all other execution witness and pass herein in form as officers and thereto they Constitute Their Peers & In Witness whereof these presents and the marginal note wrote on stamped paper by Robert Marshall Writer of Kinross are subscribed by the said parties as follows viz. by said John Hay and David Chalmers at Kinross the twelfth day of January one thousand eight hundred and eight before these witnesses the said Robert Marshall and Robert Low his Clerk.

The within designed David Chambers having served me up to this date faithfully and honestly I the within designed John Hay in consideration for a certain sum of money do hereby discharge said David Chamber of the within Indenture and of the period yet to run thereof In witness whereof I have subscribed this discharge wrote by the within designed Robert Marshall at Kinross the tenth day of January eighteen hundred and twelve years before these Witnesses the said Robert Marshall and Henry Morison 2nd.
